an wearing ski mask shot by acquaintance
By Jonathan Weaver, Salisbury Post
A Rowan County man shot an acquaintance who was standing in his front yard wearing a ski mask and carrying an ax handle early this morning.
Gary Wayne Shrewsbury, 45, of 4915 U.S. 601, said he didn't know the man was Ralph Samuel Avins, 33, of 855 Tanner Road, Richfield, until after the shooting, according to a Rowan CountySheriff's Department report.
Paramedics took Avins to Rowan Regional Medical Center, and he later was taken to Wake Forest University Baptist Medical Center in Winston-Salem. His condition was not known late this morning.
Shrewsbury could not be reached for comment.
Shrewsbury told deputies that a noise outside his northern Rowan County home awakened him shortly after 4 a.m. today. Shrewsbury noticed his outside light was off, so he grabbed a .357-caliber Magnum handgun and went to investigate.
Once outside, he spotted a shadowy figure at the corner of his home, then saw a man wearing a ski mask walking toward him. The man also carried what appeared to be an ax handle, the report said.
Shrewsbury told investigators he ordered the man to stop. But the man kept coming, so Shrewsbury fired a shot into the man's stomach, Chief Deputy Steve Schenk said. Shrewsbury then called 911.
After the shooting, Avins pulled off the ski mask and asked why Shrewsbury shot him, Schenk said.
Schenk said once investigators interview Avins, they will present the case to District Attorney Bill Kenerly to determine if charges will be filed against Shrewsbury.
